The Attorneys of the Litigation and Arbitration Department represent and assist Italian
and foreign Clients on civil and administrative disputes pending before Italian
and European jurisdictional Organs, including proceedings presented before the
State Auditors' Department (Corte dei Conti), the Court of Cassation (Corte di
Cassazione), the State Council (Consiglio di Stato), the Constitutional Court
(Corte Costituzionale) and the European Court of Justice (Corte di Giustizia
Europea). In addition, the Litigation Department's professionals provide Clients
with worldwide assistance through the Firm's own foreign offices and capillary
network of qualified foreign law firms.
Particular emphasis is placed on pre-litigation assistance in order to prevent
or settle possible disputes, even by implementing alternative dispute resolution
(ADR) practices, through the arrangement of settlements agreements and extrajudicial
conciliation acts.
Likewise, the Department has specific competence in assisting Italian and
foreign Clients in arbitration proceedings before national and international
organs (for example the ICC - International Chamber of Commerce) either as
counsel for defense or arbiter named by one of the parties.
With particular reference to international Clients, the Department's Attorneys
have consolidated experience in recognition and execution proceedings of foreign
jurisdiction's provisions in the application of national directives and international
Agreements and also in settlement of jurisdiction conflicts according to international
Agreements and European Union directives.
After the introduction of Corporate Law reforms and the constitution of specialized
sections for Intellectual and Industrial Property matter, the Litigation Department's
professionals adapted their services to comply with the new applicable discipline.
The Department's Attorneys have successfully debated numerous disputes regarding
industrial and intellectual property, unfair competition, contractual, corporate,
real estate, financial, banking and extra-contractual issues, bankruptcy, tenders
and succession.
In consideration of the upcoming computerization of civil lawsuits, the Litigation
Department's professionals are already equipped with the necessary technology
to manage trials and to exchange acts and information with judiciary offices
through digital signature.
