The domain names protection service, initially offered by the Intellectual Property
Department, has recently developed into a Department within the Firm itself,
offering administrative and jurisdictional legal assistance on domain names protection
and recovery.
The Firm's service of jurisdictional protection consists of arranging
and handling precautionary claims against hypothetical abusive registrations
of domain names (so called domain grabbing or cyber-squatting)and involves
managing matters of unfair competition and Industrial Property infringements.
Judicial assistance is also available in foreign jurisdictions.
The administrative assistance on domain names in the country code ".it" views
Tonucci & Partners as one of the Italian Managing Bodies in the field to
operate alternative dispute resolution in reference to the so called "reassignment
procedure for domain names": a special section is available for claims
and on-line procedure. Tonucci & Partners is distinguished in the domain
name protection sector as a founding member of the Managing Bodies Coordination Association for Italian reassignment procedures - CEC, whose aim is to
promote and sustain alternative dispute resolution practices for domain names
disputes by representing its associates before suitable entities for registering
domain names and fixing the criteria on domain names assignation, re-assignation
and cancellation procedures and by handling the relative disputes.
At an international level, the Firm's Attorneys represent and assist
clients in arbitration and mediation procedures set by the World
Intellectual Property Organization that can be started by subjects claiming for domain names
abuses mainly concerning the generic top level domains(gtld) (.com, .org, .net,
.edu, .int, .biz, .info, .name, .coop, .aero, .museum, .pro, .mil, etc).
The Department services also include:
- Assisting Clients in the adequate planning of their Intellectual Property
Rights protection strategies involving domain name choices.
- Contractual assistance on cc.tld ".it" domain names related
acts on the basis of the art. 6 of Technical Registration Procedures - Version
4.0 (consensual transfer of domain names, particular or universal succession
mortis causa, company or company branch transfer, company transformation,
acquisition or merger).
- Registration with competent national and international Authorities.
- Continuous Monitoring to protect Client's domain names portfolio.
